Restoration

If your legal status in Canada as a visitor, worker, or student has expired, you may still have the opportunity to stay in the country—through the Restoration of Status process. Restoration of status allows you to regain your legal immigration status in Canada within 90 days after your temporary status has expired. This applies if you failed to apply for an extension before your permit or visa expired.

Important: You must remain in Canada during the restoration process. Leaving the country automatically makes you ineligible to apply for restoration.

Types of Restoration:

1. Visitor Visa Restoration

For tourists or family visitors who overstayed
Must show intent to leave or apply for proper extensions

2. Worker Permit Restoration

You held a valid work permit and wish to resume working (with the same or new employer)
May require a new Labour Market Impact Assessment (LMIA) or employer-specific offer

3. Study Permit Restoration

For international students who want to resume or continue studies
Must show continued enrollment in a Designated Learning Institution (DLI)

Who Can Apply?
You may be eligible for restoration if:

Your status expired less than 90 days ago
You have not violated other visa conditions (e.g. illegal work or study)
You continue to meet the requirements of your original visa or permit
